2022 legislative work plan of the State Council
 
2022 is an important year to enter the new journey of building a modern socialist country in an all-round way and marching towards the second Centennial goal. Our party will hold the 20th National Congress. We should deeply understand the decisive significance of the”two establishment”, strengthen the”Four Consciousness”, strengthen the”four self-confidence”, achieve the”two maintenance”, unswervingly follow the socialist road of rule of law with Chinese characteristics, adhere to the organic unity of the party’s leadership, the people being masters of the country, and the rule of law, adhere to the general tone of seeking progress while maintaining stability, grasp the new development stage, implement the new development concept, build a new development pattern, and promote high-quality development, We should strengthen legislation in key areas, emerging areas and foreign-related areas, constantly improve the quality and efficiency of legislation, ensure high-quality development with high-quality legislation, accelerate the improvement of the socialist legal system with Chinese characteristics, provide a strong legal guarantee for promoting the modernization of the national governance system and governance capacity, and comprehensively build a socialist modern country, and take practical actions to meet the victory of the 20th CPC National Congress.
 
 
The Sixth Plenary Session of the 19th CPC Central Committee is a meeting of great historical significance held at the centenary of the founding of the party. The resolution of the Central Committee of the Communist Party of China on the major achievements and historical experience of the party’s Centennial struggle, adopted at the plenary session, systematically reviewed the historical achievements and changes in the cause of the party and the country since the founding of the Communist Party of China, especially since the 18th CPC National Congress, and comprehensively summarized the valuable historical experience accumulated by the party’s Centennial struggle. We should thoroughly study and implement the spirit of the Sixth Plenary Session of the 19th CPC Central Committee, deeply understand the decisive significance of the”two establishment”, draw forward wisdom and strength from the great achievements and historical experience of the party’s hundred years of struggle, and take on the historical mission of legislative work entrusted by the new era with practical work results.
 
Make every legislation conform to the spirit of the Central Committee, reflect the characteristics of the times and reflect the will of the people.
 
 II. Scientifically and reasonably arrange legislative projects to better serve and ensure the major decisions and arrangements of the party and the state
 
We should focus on the center, serve the overall situation, highlight the key points, adapt to the requirements of basing ourselves on the new development stage, implement the new development concept, construct a new development pattern, and promote high-quality development, closely follow the major decisions and arrangements of the Party Central Committee, closely follow the voice and expectation of the people for a better life for legislative work, closely follow the actual legislative needs of the modernization of the national governance system and governance capacity, and scientifically and reasonably arrange legislative projects, Ensure and promote the smooth realization of the goals and tasks of economic and social development with high-quality legislation.
 
Focusing on comprehensively deepening reform and opening up and promoting high-quality economic development, the Standing Committee of the National People’s Congress was submitted to review the draft tariff law, the draft value-added tax law, the draft financial stability law and the draft revision of the railway law. Formulate the regulations on urban public transport, several provisions of the State Council on the comprehensive management of anti smuggling, and revise the regulations on the administration of commercial passwords and the detailed rules for the implementation of the patent law. The draft of the national development planning law, the draft of the consumption tax law, the draft of the telecommunications law, the revised draft of the anti unfair competition law, the revised draft of the accounting law, the revised draft of the banking supervision and administration law, the revised draft of the people’s Bank of China Law, the revised draft of the commercial banking law, the revised draft of the anti money laundering law, the revised draft of the insurance law, the revised draft of the measurement Law, the revised draft of the foreign trade law Revised draft of the arbitration law. Prepare to formulate regulations on the administration of state-owned financial capital, regulations on the supervision and administration of local finance, regulations on the supervision and administration of listed companies, prepare to revise the invoice management measures, regulations on the National Natural Science Foundation, regulations on the protection of new plant varieties, measures for the administration of state-owned assets evaluation, special provisions of the State Council on the overseas offering and listing of shares by limited liability companies, and provisions of the State Council on the reporting standards of business concentration.
 
Focusing on upholding administration according to law and strengthening the government’s own construction, the Standing Committee of the National People’s Congress was submitted to review the revised draft law on public security administration penalties and the revised draft law on administrative reconsideration. It is prepared to submit to the Standing Committee of the National People’s Congress for deliberation the draft law on the protection of the operation of organs, the revised draft law on the people’s police, the revised draft Customs Law, and the revised draft statistics law. Prepare to revise the Provisional Regulations on the registration administration of public institutions. Improve the legal system of road traffic safety management.
 
Focusing on developing advanced socialist culture and enhancing cultural self-confidence, the revised draft of the law on the protection of cultural relics was submitted to the Standing Committee of the National People’s Congress for deliberation. Formulate regulations on the protection of minors’ networks and revise the regulations on the protection and administration of underwater cultural relics. The draft radio and television law will be submitted to the Standing Committee of the National People’s Congress for deliberation.
 
Focusing on ensuring and improving people’s livelihood and enhancing people’s well-being in the process of development, the draft preschool education law, the draft academic degree law, the draft social assistance law, the draft public health emergency response law, the revised draft infectious disease prevention and control law, and the revised draft frontier health inspection law were submitted to the Standing Committee of the National People’s Congress for deliberation. Formulate regulations on social insurance handling, regulations on the safety management of biotechnology research and development, regulations on the management of clinical research and transformation and application of new biomedical technologies, and revise the regulations on human organ transplantation. We are going to submit the draft of the medical security law, the revised draft of the organic law of urban residents’ committees, and the revised draft of the teachers’ law to the Standing Committee of the National People’s Congress for deliberation. We will promote legislation on the supervision of out of school education and training. We will promote the rule of law in the registration and management of social organizations.
 
Focusing on strengthening the protection of the ecological environment and building a beautiful China, the draft energy law and the revised draft mineral resources law were submitted to the Standing Committee of the National People’s Congress for deliberation. Formulate ecological protection compensation regulations, Interim Regulations on the management of carbon emission trading, and revise the regulations on the safety and protection of radioisotopes and radiation devices. The draft law on the protection of cultivated land and the draft amendment to the law on entry and exit animal and plant quarantine will be submitted to the Standing Committee of the National People’s Congress for deliberation.
 
Focusing on overall development and security and improving the legal system of national security, the draft food security law was submitted to the Standing Committee of the National People’s Congress for deliberation. Formulate regulations on the administration of network data security, regulations on consular protection and assistance, and Interim Regulations on the administration of pilotless aircraft flight. It is prepared to submit to the Standing Committee of the National People’s Congress for deliberation the draft law on the safety of hazardous chemicals, the draft law on the national comprehensive fire rescue team and personnel, and the revised draft law on the protection of state secrets. Prepare to formulate coal mine safety regulations.
 
The draft laws that need to be submitted to the National People’s Congress and its Standing Committee for deliberation, as well as the administrative regulations that need to be formulated and revised, should be submitted to the State Council and the Central Military Commission for deliberation in due course.
 
We should pay close attention to the clean-up of laws and regulations related to the transformation of government functions, the”deregulation and service” reform, the”separation of certificates and licenses” reform, and the optimization of the business environment.
 
In order to implement high-level opening-up, open up a new situation of win-win cooperation, promote the construction of a new type of international relations and a community with a shared future for mankind, and carry out the review of relevant international treaties.
 
For other legislative projects assigned by the Party Central Committee and the State Council, we should speed up the handling of them and complete the drafting and review tasks as soon as possible.
 
For other legislative projects under study but not included in the legislative work plan, the relevant departments shall continue to study and demonstrate.

III. improve the legislative working mechanism, promote development with good laws and ensure good governance
 
Always adhere to the centralized and unified leadership of the party over legislative work. We should carry out legislative work closely around the overall situation of the work of the party and the state, promote the implementation of the major decisions and arrangements of the Party Central Committee on legislative work, accelerate the completion of major legislative projects assigned by the Party Central Committee, and constantly strengthen the legal guarantee of major national development strategies. Strictly implement the system of asking for instructions and reports from the Party Central Committee, and timely ask for instructions and reports from the Party Central Committee on major legislative matters determined by the Party Central Committee, as well as major institutional and policy adjustments involved in the legislative work. The legislative work plan and major legislative projects shall be submitted to the Central Committee for comprehensive rule of law for deliberation as required, and the Central Committee for comprehensive rule of law and Its Legislative Coordination Group and office shall be supported to play a functional role. We should promote the party’s leadership into law and regulation, improve the legal system for the party’s leadership of various undertakings, and constantly improve the institutionalization and rule of law of the party’s leadership. Deeply analyze the legislative needs of the construction of socialist core values, and promote the integration of socialist core values into legislation.
 
Support and cooperate with the people’s Congress to play a leading role in legislative work. Comprehensively implement the legislative plan of the Standing Committee of the National People’s Congress and relevant legislative work plans, do a good job in the connection of legal projects, and strengthen communication and coordination. We will strengthen the synergy between government legislation and the legislation of the National People’s Congress, and make overall arrangements for the relevant and supporting work of legislation, revision, abolition, interpretation and compilation of laws, regulations and rules. Give full play to the role of deputies to the National People’s Congress, and carefully listen to the opinions and suggestions of deputies to the National People’s Congress when drafting and reviewing important draft laws and regulations, so as to better ground the legislation, observe the people’s conditions, gather the people’s wisdom, and benefit the people’s livelihood.
 
Thoroughly implement the people-centered legislative concept. Insist on asking the people about their needs, plans and effects, actively respond to the new requirements and expectations of the people for the legislative work, constantly improve the legal system necessary to meet the growing needs of the people for a better life, implement the embodiment of the interests of the people, the will of the people, the safeguarding of the rights and interests of the people, and the promotion of the well-being of the people into the whole process of legislative work in all fields, and strive to make the people项法律制度中都感受到公平正义。贯彻和体现发展全过程人民民主的重大理念和实践要求,健全吸纳民意、汇聚民智的工作机制,积极运用新媒体新技术拓宽社会公众参与立法的渠道,注重听取基层立法联系点意见,努力做到民有所呼、我有所应,充分凝聚立法共识。聚焦人民群众急盼,加强民生领域立法。对人民群众反映强烈的突出问题,加快完善相关法律制度,补齐监管漏洞和短板。加强对立法工作的宣传,把普法融入立法过程,及时宣传解读新出台的法律法规,特别是人民群众普遍关心关注、与推动经济社会高质量发展密切相关的法律法规,积极回应立法热点问题,讲好新时代立法工作的成就和故事,不断提升人民群众对法律制度的认同感。
 
  着力提升立法的科学性和针对性。把改革发展决策同立法决策更好结合起来,在研究改革方案和改革措施时,要同步考虑改革涉及的立法问题,及时提出立法需求和立法建议,确保国家发展、重大改革于法有据。不断丰富立法形式,统筹谋划和整体推进立改废释纂各项工作,切实避免越权立法、重复立法、盲目立法,有效防止部门利益影响。起草、审查法律法规草案时,同一或相近领域有关法律法规应相互衔接,避免出现法律规定之间不一致、不协调、不适应问题。聚焦法律制度的空白点和冲突点,既注重“大块头”,也注重“小快灵”,从“小切口”入手,切实增强立法的针对性、适用性、可操作性,着力解决现实问题。统筹推进国内法治和涉外法治,加强涉外领域立法,补齐涉外法律制度短板,加快我国法域外适用的法律体系建设,坚决维护国家主权、安全和发展利益。
 
  健全完善立法风险防范机制。立法工作事关国家安全、政治安全和社会稳定,必须贯彻落实总体国家安全观,坚持底线思维、增强忧患意识,加强立法战略研究,对立法时机和各环节工作进行综合考虑和评估论证,把风险评估贯穿立法全过程,着力防范各种重大风险隐患,为党的二十大胜利召开创造安全稳定的政治社会环境。
 
  切实加强法规规章备案审查工作。充分发挥立法监督作用,严格落实“有件必备、有备必审、有错必纠”工作要求,不断提升法规规章备案审查工作质效,切实维护国家法治统一。对报送备案的法规规章依法审查,着重对法规规章是否全面贯彻党的路线方针政策、是否违背法定程序、是否超越法定权限、是否违反上位法规定等进行审查,对发现的问题坚决依法作出处理。持续加强备案审查能力建设,研究修改备案审查法律制度,优化完善备案法规规章数据库,及时向国务院报告年度备案审查工作情况,不断提高备案审查工作规范化、科学化、精细化水平。
 
  持续推进立法工作队伍建设。牢牢把握忠于党、忠于国家、忠于人民、忠于法律的总要求,大力提高立法工作队伍思想政治素质、业务工作能力、职业道德水准。教育引导立法工作队伍把政治建设摆在首位,坚持以习近平新时代中国特色社会主义思想武装头脑,不断提高政治判断力、政治领悟力、政治执行力,加快推进革命化、正规化、专业化、职业化建设。落实党中央关于法治人才培养的决策部署,健全招录制度,加大交流力度,加强教育培训,不断提升立法工作人员遵循规律、发扬民主、加强协调、凝聚共识的能力。
 
  四、切实加强组织领导,确保高质高效完成立法工作任务
 
  国务院各部门要深刻认识立法工作在全面建设社会主义现代化国家中的基础性、保障性作用,高度重视立法工作计划的贯彻执行,聚焦重大部署、重要任务、重点工作,加强组织领导,明确责任分工,主动担当作为,狠抓贯彻落实,在确保立法质量的前提下加快立法工作步伐,高质高效完成各项立法工作任务。
 
  起草部门要紧紧抓住提高立法质量这个关键,遵循立法程序,严守立法权限,深入调查研究,总结实践经验,广泛听取意见,认真做好向社会公开征求意见工作。送审稿涉及其他部门的职责或者与其他部门关系紧密的,应当与有关部门充分协商;涉及部门职责分工、行政许可、财政支持、税收优惠政策的,应当征得机构编制、审改、财政、税务等相关部门同意。起草过程中遇到意见分歧的,应当主动沟通协调,难以解决的重大意见分歧应当及时按程序请示汇报。对于改革发展稳定急需的重大立法项目,必要时成立立法工作专班,协调推动立法进程,集中力量攻坚,确保按时完成起草任务。送审稿涉及重大体制改革、重要改革事项的,应当按照中央已经确定的改革方案对有关内容进行修改完善后再报送。起草部门要按时向国务院报送送审稿、说明和有关材料,为审查、审议等工作预留合理时间。报送送审稿前,起草部门应当与司法部做好沟通,如实说明征求各方意见、公开征求意见、协调重大分歧、落实改革方案以及设定行政许可、行政强制、行政处罚等情况。
 
  司法部要及时跟踪了解立法工作计划执行情况,加强组织协调和督促指导。对于党中央、国务院高度重视,时间要求紧迫的重大立法项目,要加强与起草部门的沟通,必要时提前介入、加快推动,确保程序不减、标准不降、无缝衔接、按时完成。起草部门报送的送审稿存在《行政法规制定程序条例》第十九条规定的情形的,司法部可以缓办或者将送审稿退回起草部门。在审查过程中,有关部门对送审稿涉及的主要制度、方针政策、管理体制、权限分工等有不同意见的,司法部应当加大协调力度,提高协调层级,妥善处理分歧,避免久拖不决。经过充分协调不能达成一致意见的,司法部、起草部门应当及时按程序上报。
