HEMA supplier was fined 50000 for exceeding the standard of heavy metal pollutants in skin shrimp

Food partner online news Recently, the Shanghai municipal market supervision and Administration Bureau released an administrative penalty information. Shanghai Jiyuan Food Co., Ltd. (hereinafter referred to as”the party”) was fined 50000 yuan by the Shanghai Putuo District market supervision and Administration Bureau for selling skin shrimp products with excessive heavy metal pollutants.
 
The administrative punishment decision shows that on January 4, 2022, the Shanghai Putuo District market supervision and Administration Bureau decided to file an investigation into the behavior of the Party Shanghai Jiyuan Food Co., Ltd. in selling unqualified skin shrimp.
 
The Party Shanghai Jiyuan Food Co., Ltd. is a aquatic product business enterprise, and the party sells seafood and other primary agricultural products to the business premises of the branch of Shanghai HEMA Network Technology Co., Ltd. in accordance with the commercial agreement. It also has retail stores in Jiangyang market in Baoshan District to engage in the retail activities of seafood products. The parties concerned sell and supply to the corresponding stores according to the order information of hemamen store.
 
On April 15, 2021, the party concerned sold 2kg shrimps to Suzhou Wuzhong branch of Shanghai HEMA Network Technology Co., Ltd. at a sales price of 110 yuan /kg. The product was purchased from Nantong Xincheng fresh aquatic products Co., Ltd. with a quantity of 50kg and a purchase price of 60 yuan /kg. It has been sold out without inventory, and the purchase has not been invoiced.
 
On the same day, Suzhou Wuzhong District market supervision and Administration Bureau entrusted a third-party inspection institution, Suzhou Institute of product quality supervision and inspection, to conduct supervision and sampling inspection on the above-mentioned skin shrimp. The inspection report numbered no:bjvs210972 shows the main contents as follows:food name:skin shrimp; Purchase date:April 15, 2021; Sample quantity:1.248kg; Sampling base:1.248kg. Inspection conclusion:”after sampling inspection, the cadmium (calculated by CD) item does not meet the requirements of gb2762-2017 national food safety standard limit of pollutants in food, and the inspection conclusion is unqualified”. Among them, test item:cadmium (calculated by CD) mg/kg; Standard index:≤ 0.5; Measured value:1.2; Single determination:unqualified.
 
The heavy metal pollutants of the above-mentioned skin shrimp sold by the parties exceed the standard and do not meet the requirements of the national food safety standards. The sales value of the above skin shrimp is 5500 yuan, and the illegal income is 2500 yuan. The party concerned has fulfilled the obligation of incoming inspection of the product according to law.
 
The behavior of the parties involved in selling skin shrimp products with excessive heavy metal pollutants, In violation of item (2) of Article 34 of the food safety law of the people’s Republic of China,”the production and operation of the following foods, food additives and food related products are prohibited:(2) pathogenic microorganisms, pesticide residues, veterinary drug residues, biotoxins, heavy metals and other pollutants, as well as other substances harmful to human health that exceed the limit of food safety standards”.
 
According to the relevant provisions of item 1, paragraph 1, Article 124 of the food safety law of the people’s Republic of China, the Shanghai Putuo District market supervision and Administration Bureau decided to impose the following penalties:1. Confiscate the illegal income (RMB) twothousand five hundred yuan only; 2、 Fine (RMB) 50000 yuan only.
