Administrative measures for the registration of small food production and processing workshops of the Guangdong provincial market supervision and Administration Bureau

Chapter I General Provisions
 
Article 1 in order to strengthen the administration of small food production and processing workshops (hereinafter referred to as small food workshops), these measures are formulated in accordance with the food safety law of the people’s Republic of China, the administrative license law of the people’s Republic of China, and the regulations of Guangdong Province on the Administration of small food production and processing workshops and food vendors (hereinafter referred to as the administrative regulations).
 
Article 2 These measures are applicable to the registration and management of small food workshops within the administrative region of the province.
 
A small food workshop engaged in food production and processing within the administrative region of the province shall obtain a small food workshop registration certificate. Those who have not obtained the registration certificate of small food workshops shall not engage in the production and processing activities of small food workshops.
 
Article 3 the food safety supervision and Administration Department of the provincial people’s government is responsible for guiding the registration of small food workshops in the province.
 
The food safety supervision and Administration Department of the Municipal People’s government is responsible for managing the registration of small food workshops in its administrative region, and formulating and adjusting the catalogue of prohibited production and processing of small food workshops in its administrative region in accordance with the provisions of the administrative regulations.
 
The food safety supervision and Administration Department of the people’s government at the county level is responsible for the implementation of the registration of small food workshops within its administrative region.
 
Article 4 the registration of small food workshops shall follow the principles of openness, fairness, impartiality and convenience.
 
Article 5 small food workshops shall engage in food production and processing activities in accordance with the corresponding food safety standards within the scope of registered food categories. The types of food shall be classified according to the classification principles of food production license.
 
Article 6 the food safety supervision and administration departments of the people’s governments at or above the county level should speed up the informatization construction of the registration of small food workshops, promote the online processing of the whole process of application, acceptance, on-site verification, examination and approval, certificate issuance, inquiry, and publish the registration items on the website of the administrative organs to improve the efficiency.
 
Chapter II registration procedures
 
Article 7 to apply for the registration certificate of a small food workshop, a business license shall be obtained first. Submit the following materials to the food safety supervision and Administration Department of the people’s government at the county level where the applicant is located:
 
(1) application for registration of small food workshops;
 
(2) a copy of the identity card of the person in charge;
 
(III) the process flow chart of the food produced and the plan of the production site.
 
Employees who have direct contact with the production and processing of imported food can submit a copy together with the health certificate. The application materials submitted shall be true, legal and valid. The applicant shall sign or seal on the materials for confirmation.
 
Article 8 the food safety supervision and Administration Department of the people’s government at the county level shall issue the notice of acceptance or the notice of rejection within five working days from the date of receiving the application for registration of small food workshops. If the case is not accepted, the reasons for the rejection shall be explained.
 
If the application materials are incomplete or do not conform to the legal form, the applicant shall be informed of all the contents that need to be supplemented and corrected on the spot or within five working days at a time. If the applicant fails to inform within the time limit, it shall be accepted from the date of receiving the application materials.
 
Article 9 the food safety supervision and Administration Department of the people’s government at the county level shall complete the data review within five working days from the date of accepting the application. The first application for the registration certificate of a small food workshop shall be subject to on-site verification, and the application for renewal or change of the registration certificate of a small food workshop can be subject to on-site verification when necessary.
 
The on-site inspection shall be carried out by two supervisors appointed by the food safety supervision and Administration Department of the people’s government at the county level in accordance with the key points for on-site inspection of small food production and processing workshops in Guangdong Province, and the applicant shall cooperate with them by filling in the on-site inspection form of small food production and processing workshops in Guangdong Province.
 
Except for force majeure, if the on-site inspection cannot be carried out within the specified time limit due to the applicant’s reasons, it shall be treated as unqualified in the on-site inspection.
 
Article 10 after on-site verification, those who meet the conditions shall be publicized before issuing the certificate, and the publicity time shall not be less than five working days.
 
During the publicity period, if any unit or individual has any objection to the publicized applicant and small food workshop, it can raise an objection to the food safety supervision and Administration Department of the county-level people’s government. The food safety supervision and Administration Department of the county-level people’s Government shall verify the relevant situation within three working days from the date of receiving the objection, and will not register the objection if it is tenable; If the objection is not tenable or there is no objection, the registration certificate of small food workshop shall be issued within 20 days from the date of accepting the application.
 
Article 11 if the registration certificate of a small food workshop is not issued if the conditions are not met, the food safety supervision and Administration Department of the people’s government at the county level shall make a written decision not to register and explain the reasons.
 
Article 12 the registration certificate of small food workshops shall be valid for three years, and an application for renewal shall be submitted to the food safety supervision and Administration Department of the local people’s government at the county level 30 days before the expiration of the valid period; If an application for renewal is filed within the time limit, it shall be handled in accordance with the newly applied registration certificate of small food workshop.
 
The food safety supervision and Administration Department of the people’s government at the county level shall, according to the application, make a decision on whether to grant the extension before the expiration of the registration certificate of small food workshops; If no decision is made within the time limit, it shall be deemed that the extension is allowed.
 
If the extension is allowed, a new small food workshop registration certificate shall be issued, with the registration certificate number unchanged, and the period of validity shall be calculated from the date when the food safety supervision and administration department makes the extension decision. If the extension is not allowed, the food safety supervision and administration department shall make a written decision not to continue and explain the reasons.
 
Article 13 If a small food workshop applies for renewal, it shall show the applicant’s ID card and submit the following materials:
 
(1) application for continuation of small food workshops;
 
(II) the process flow chart of the food produced and the plan of the production site.
 
The application materials submitted shall be true, legal and valid. The applicant shall sign or seal on the materials for confirmation.
 
Article 14 within the validity period of the registration certificate of a small food workshop, in case of any of the following circumstances, the small food workshop shall submit an application for change to the food safety supervision and Administration Department of the local people’s government at the county level within three working days:
 
(1) the name of a small food workshop changes;
 
(2) the name of the production and processing address changes;
 
(3) relocation of production and processing sites;
 
(4) changes in the type of food, equipment layout and technological process;
 
(5) major changes have taken place in production and processing equipment and facilities;
 
(6) other circumstances that should be applied for change as stipulated by laws and regulations.
 
In case of one of the circumstances in items (3) to (5) of the preceding paragraph, the food safety supervision and Administration Department of the people’s government at the county level shall organize on-site verification in accordance with the provisions of Article 9 of these measures. If the change is approved, the change procedures shall be handled within three working days after accepting the change application. The number of the changed small food workshop registration certificate remains unchanged, and the issuing date is the date on which the food safety supervision and administration department makes the change decision, and the period of validity is the same as the original certificate. However, for on-site verification due to relocation and other reasons, the validity of the changed small food workshop registration certificate shall be recalculated from the date of issuance. If no change is made, a written decision shall be made and the reasons shall be explained.
 
If the relocation of production and processing sites crosses administrative regions, the original registration certificate of small food workshops shall be cancelled, and the registration certificate of small food workshops shall be reapplied at the place of relocation.
 
Article 15 If a small food workshop applies for change, it shall show the applicant’s ID card and submit the following application materials.
 
(1) application for change of small food workshop;
 
(2) the original registration certificate of the small food workshop;
 
(III) the business license change approval certificate related to the change, as well as the process flow chart of the food produced and the plan of the production site and other materials.
 
The application materials submitted shall be true, legal and valid. The applicant shall sign or seal on the materials for confirmation.
 
Article 16 If a small food workshop applies for the cancellation of the registration certificate of small food workshops, it shall submit the Cancellation Application and the original of the registration certificate of small food workshops to the food safety supervision and Administration Department of the people’s government at the county level that originally issued the certificate. If the registration certificate of a small food workshop is cancelled, the registration certificate number shall not be used again.
 
Article 17 under any of the following circumstances, the food safety supervision and Administration Department of the people’s government at the county level shall go through the cancellation procedures of the registration certificate of small food workshops according to law within five working days:
 
(1) the registration certificate of a small food workshop is revoked or revoked according to law;
 
(2) the small food workshop applies for cancellation or the registration certificate of the small food workshop expires without applying for renewal;
 
(3) the small food workshop is terminated according to law;
 
(4) the registration items cannot be implemented due to force majeure;
 
(V) other circumstances under which the registration certificate of small food workshops should be cancelled as stipulated by laws and regulations.
 
Article 18 under any of the following circumstances, the food safety supervision and Administration Department of the people’s government at the county level may revoke the registration certificate of small food workshops:
 
(1) a staff member of an administrative organ abuses his power and neglects his duty to make a decision to approve registration;
 
(2) making a decision to approve registration beyond its statutory authority;
 
(3) making a decision to approve registration in violation of legal procedures;
 
(4) approving the registration of applicants who are not qualified or do not meet the statutory requirements;
 
(5) other circumstances under which the registration may be revoked according to law.
 
If the registrant obtains the registration by cheating, bribery or other improper means, it shall be revoked.
 
Chapter III Registration Certificate
 
Article 19 the registration certificate of a small food workshop shall contain the name, address, person in charge, type of food, certificate number, period of validity and other information of the small food workshop.
 
The food safety supervision and Administration Department of the provincial people’s government is responsible for formulating the registration certificate of small food workshops. The food safety supervision and Administration Department of the people’s government at or above the county level is responsible for the printing and issuance of the registration certificate of small food workshops in its administrative region.
 
Article 20 small food workshops shall hang or place the registration certificate of small food workshops in a prominent position; The registration certificate of small food workshop shall not be transferred, rented or lent. It is forbidden to forge or alter the registration certificate and number of small food workshops.
 
If the registration certificate of a small food workshop is lost or damaged, the small food workshop may apply for a replacement certificate from the food safety supervision and Administration Department of the local people’s government at the county level.
 
Article 21 a small food workshop shall mark its food package with the registration certificate number of the small food workshop. If it is difficult to package and mark, the number of small food workshop registration certificate shall be marked on its storage location and sales container.
 
Article 22 the number of small food workshop registration certificate is composed of English letters”GD” + nine Arabic numerals. The first two digits are the administrative region code of the prefecture level city, the third and fourth digits are the county (District) code, and the last five digits are the serial number of the food workshop registration certificate.
 
For example:gd010312345. The first two digits”01″ represent Guangzhou, the third and fourth digits”03″ represent Liwan District, Guangzhou, and the last five digits”12345″ represent the serial number of the food workshop registration certificate.
 
Chapter IV supplementary provisions
 
Article 23 从事现场制售即食食品的单位和个人,不适用本办法。
 
  第二十四条  本办法由广东省市场督管理部门负责解释。
 
  第二十五条  本办法自2022年8月12日起施行,有效期5年。有关法律依据变化或者有效期届满,根据实施情况依法评估修订。
