   In order to implement the”Food Production License Management Measures” (State Administration for Market Regulation Order No. 24, hereinafter referred to as the”Measures”), comprehensively promote the reform of the food production license approval system, improve the”Internet + production license”, and further improve License work efficiency and service level, provide enterprises with a relaxed and favorable business development environment, guide market supervision departments at all levels to implement the food (excluding special food, the same below) production license system in accordance with the state and the city’s”decentralized control service””Separation of licenses and licenses”,”one system, three modernizations” and the deployment of the promotion of system and mechanism innovation in the Binhai New Area, combined with the actual food production license of this city, hereby notify the relevant work of the city’s food production license as follows:
   One. Division of Food Production Licensing Functions
   (1) Municipal Market Supervision Commission
  1. Responsible for organizing, implementing, supervising and guiding the city’s food production license work; adjusting food production license management authority according to work needs; organizing the quality supervision and inspection of food production license work; responsible for organizing the formulation of local special food production license review rules.
  2. Responsible for the development, management and maintenance of the city’s food production license management system, responsible for the maintenance of the city’s food production license data and technical support for the disclosure of license information, and responsible for data connection with the food production license information system of the General Administration of Market Supervision.
  3. Responsible for organizing and implementing the food production license management within the license authority, including the acceptance, approval, license issuance, cancellation, and cancellation of food production licenses.
   (2) District Market Supervision Bureau
   1. Responsible for organizing and implementing the food production license management within the license authority, including the acceptance, review, approval, issuance, cancellation, cancellation, and archiving of food production licenses.
   2. Responsible for the quality supervision and inspection of the lower-level food production license work.
  3. Responsible for the training, assessment and daily management of on-site inspectors in the district.
  (3) Municipal Food and Industrial Product License Examination and Inspection Center (hereinafter referred to as”Examination Center”)
   1. Responsible for the review and filing of food production licenses within the municipal level license authority.
  2. Responsible for the training, assessment and daily management of municipal reviewers and professional and technical personnel.
   2. Food production permission authority
   (four) municipal authority
   is responsible for the production license of salt and supplementary food for infants and young children in the administrative area. (Excluding companies in Binhai New Area)
  (5) District level authority
   1. Binhai New Area Authority:Responsible for all food production licenses in this administrative area.
   2. Other district authority:Responsible for the production license of food except salt and supplementary food for infants and young children in this administrative district.
  (6) Cross-level approval authority
  A company applying for a food production license contains food approved at the city and district levels:
  1. If an enterprise submits an application for a food production license that only involves municipal approval authority, it shall be accepted by the district bureau, the municipal review center shall organize the review, and the municipal market supervision commission shall approve and issue the certificate.
  2. If an enterprise submits an application for a food production license that also involves the approval authority at the city and district levels, the district bureau will accept it in a unified manner, the review center will organize a joint review, the municipal and district levels will approve separately, and the municipal market supervision commission will issue a unified certificate .
  3. If an enterprise submits an application for a food production license that only involves the district-level approval authority, the district bureau shall accept, review, approve and issue a license.
  3. Food production license procedures
  (7) License Management System
  1. The whole process of application, acceptance, review, license issuance, and inquiries in our city’s food production license is handled online, and the food production license electronic certificate is issued. The permit process archives are all stored electronically.
  2. The market supervision departments at all levels can print out the food production license paper certificate according to the needs of the enterprise.
  3. In order to facilitate the elderly to handle food production licensing matters, food production licensing departments at all levels must set up manual consultations to assist the elderly who have difficulty in using smart technology to handle them.
  (8) License time limit
   1. The market supervision departments at all levels shall make a decision on whether to approve the administrative license within 10 working days from the date of acceptance of the license application.
  2. The acceptance department shall transfer the application materials to the examination department within 1 working day from the date of the acceptance decision.
  3. The review department shall complete material review and on-site verification, material sorting, summarization, and reporting within 6 working days.
  4. The approval department shall complete the review of the license materials, draft the approval opinions, and make the approval decision after approval by the leader within 3 working days.
  (9) Trial Food Inspection Report
  1. If the applicant applies for the first time or adds a food category change, the on-site inspection shall check the inspection reports for all food categories one by one; the same category of food may only be inspected for the most complicated process and the highest safety control requirements. report.
  2. The applicant shall produce trial products only when its production site, production equipment facilities, equipment layout and process flow and other production conditions meet the requirements of the”Measures”. The trial product inspection report shall be issued according to the product production cycle and The inspection cycle is determined.
  3. The inspection items of the trial-produced food inspection report shall include the food safety standards and the indicators stipulated by the enterprise’s implementation standards. The specific requirements shall be implemented in accordance with the”General Rules for Food Production License Review” and the corresponding”Food Production License Review Rules”.
  4. The inspection report can be the inspection report of the enterprise itself, or it can be entrusted to a qualified inspection agency to inspect and issue an inspection report, or the enterprise can inspect some items by itself, and other items can be inspected and issued by a qualified inspection agency report. As for the items that are self-inspected by the enterprise in the inspection report, the self-inspection capability shall be checked during the on-site inspection.
  (10) On-site inspectors
   1. The on-site inspection shall be carried out by an inspection team composed of no less than 2 food safety supervisors. The inspectors should have certain qualities and abilities.
  2. Food safety supervision personnel include public officials from market supervision and management departments at all levels, full-time personnel long-term hired by market supervision and management departments, and full-time staff long-term employed by technical review agencies.
  3. The review department can hire full-time or part-time professional and technical personnel as verifiers to participate in the on-site verification work, provide technical support, apply for and pay related fees as required.
   (11) Change of production address
   The relocation of the production site requires a new food production license.

The relocation of the production site of a food producer refers to the removal of the original production site from the original production address specified in the food production license, including the removal of the production site from the jurisdiction of the original market supervision and management department that issued the license The scope also includes those who have not moved out of the jurisdiction of the original market supervision and administration department that issued the license, but have moved away from the original production site address.
   (12) On-site verification implementation
   1. If the applicant’s production conditions change, which may affect food safety, the market supervision and management departments at all levels shall conduct on-site verification of the changes. The changes that require on-site verification mainly include:changes in food categories, changes in main production equipment and facilities, changes in process equipment layout and process flow, changes in production sites, changes in surrounding environmental conditions, and other changes that may affect food safety.
  2. If the applicant declares that the production conditions have not changed, the review department may decide not to conduct on-site inspection of the applicant and directly handle the food production license approval matters in accordance with the law. Please refer to the attachment for the format of the”Promise of Production Conditions”
  4. Food production license supervision
   (13) On-site verification problem rectification
   All district market supervision bureaus shall enter the rectification results into the”Tianjin Food Production License Management System” within 5 working days after checking the applicant’s on-site verification problem rectification situation and confirming that it is qualified.
   (fourteen) permission file archiving
  Market supervision and management departments at all levels shall file the relevant materials for food production licenses in a timely manner in accordance with the relevant provisions on file filing. The municipal review center is responsible for organizing and archiving the permit files approved at the municipal level; the district market supervision bureau is responsible for filing the permit files approved at the district level. Electronic files should be backed up regularly.
   (15) License Quality Supervision
   The market supervision departments at all levels regularly or irregularly organize the supervision and inspection of the food production license work of the lower-level departments, and the implementation of administrative license disclosure, handling procedures, approval time limits, and clean government requirements are the key supervision contents. Deal with the problems found in a timely manner.
  5. Food production license legal responsibility
   (16) Implement the”Punishment to Others” Requirements
   Where a food producer violates the provisions of the “Measures for the Administration of Food Production Licensing” and is under the circumstances specified in Article 75, paragraph 1, of the “Regulations for the Implementation of the Food Safety Law of the People’s Republic of China”, the market supervision departments at all levels shall impose legal regulations on the unit Representatives, main responsible persons, directly responsible persons in charge and other directly responsible persons shall be punished in accordance with the law.
