Hunan Provincial Market Supervision Bureau announced the second batch of typical cases of cold chain food safety law enforcement

   In order to conscientiously implement the work deployment of the State Council’s new crown pneumonia epidemic prevention and joint control mechanism, strictly implement the cold chain food epidemic prevention and control requirements, and resolutely block the risk of the epidemic spreading through cold chain food, the provincial market supervision departments at all levels have strengthened the cold Chain food, especially in the urban-rural fringe and rural cold chain food supervision and enforcement inspection work of unknown origin, continue to increase the investigation and handling of cold chain food illegal activities, and effectively protect the life, health and safety of the broad masses of people. The second batch of typical cases is now announced.
   1. The illegal sale of imported frozen pork by a food company in Shaoshan, Xiangtan City
   On September 14, 2020, Shaoshan Market Supervision and Administration Bureau of Xiangtan City conducted law enforcement inspections on the illegal sale of imported frozen pork by a food company in Shaoshan City. After verification, the company has 200 imported frozen pig large intestines (15 kg/piece) with foreign labels, no Chinese labels, no Chinese instructions, and no inspection and quarantine certificates, totaling 3,000 kg, and the value of the goods is 24,000 yuan. The company’s conduct of importing frozen food that failed to conduct inspection and quarantine in accordance with the regulations violated Article 92 and Article 34 (8) of the Food Safety Law of the People’s Republic of China. On November 9, 2020, the Shaoshan Market Supervision and Administration Bureau of Xiangtan City issued the following penalties in accordance with Article 123, Paragraph 1, Item (4) of the Food Safety Law of the People’s Republic of China:1. Confiscation of imported frozen pig intestines 3000 kg (200 pieces); 2. A fine of 288,000 yuan.
  Second, Chenzhou Zhou and Lei were suspected of selling imported edible agricultural products without inspection and quarantine and unlicensed business operations
   On December 10, 2020, the Chenzhou Municipal Market Supervision and Administration Bureau conducted a law enforcement inspection on Zhou and Lei’s failure to provide inspection and quarantine certificates and business licenses for imported frozen chicken feet in the Xiangnan Market in Beihu District. After verification, the parties involved stored 18 pieces of the above-mentioned frozen chicken feet totaling 270 kilograms in the cold storage. Their behavior violated Article 2 of the Measures for the Investigation and Punishment of Unlicensed and Unlicensed Operations; and violated Article 2 of the Measures for the Supervision and Administration of the Quality and Safety of Food Agricultural Products Market Sales. Article 15, Article 25, Article 26, Article 35; Violation of Article 2, Article 34, Article 53 and Article 65 of the Food Safety Law Regulations. On February 4, 2021, Chenzhou City Market Supervision and Administration Bureau shall comply with Article 123, Paragraph (4) and Article 126 (3) of the”Food Safety Law of the People’s Republic of China” And Article 13 of the Measures for the Investigation and Punishment of Unlicensed and Unlicensed Operations shall impose the following penalties:1. Warning; 2. Confiscation of 18 pieces (270 kg) of imported frozen chicken feet that have not been inspected and quarantined; 3. A fine of 128,000 yuan.
  3. Case of Li Mou Frozen Goods Business Department in Yuelu District, Changsha City Operating Imported Pork Belly without Quarantine
   On December 24, 2020, the Market Supervision Bureau of Yuelu District, Changsha City conducted a law enforcement inspection on the operation of imported pork belly without Chinese logo by Li Mou Frozen Goods Business Department in Yuelu District. Upon verification, the parties involved operate 37 pieces of frozen pre-packaged pork belly imported from the Netherlands with a total weight of 444kg. There are no purchase receipts, quarantine certificates, nucleic acid test reports and disinfection certificates. 120kg has been sold and the illegal income is 730 yuan. The behavior of the parties Violated the provisions of Article 25 (6) and (11) of the”Measures for the Supervision and Administration of the Quality and Safety of Edible Agricultural Products Market Sales” and the State Council’s”Notice on Printing and Distributing the Work Plan for Preventive and Comprehensive Disinfection of Imported Cold Chain Food” (Joint Prevention and Control Mechanism Zongfa [2020] No. 255). On January 18, 2021, the Market Supervision and Administration Bureau of Yuelu District, Changsha City issued the following penalties in accordance with Article 126 (3) of the Food Safety Law of the People’s Republic of China:1. Confiscation of illegal income of 730 yuan; 2. 37 pieces of pork belly were confiscated, 444kg; 3. A fine of 290,000 yuan was imposed; a total of 290,730 yuan was fined and confiscated.
  4. Case of Dongan Branch of a Yongzhou Supermarket Co., Ltd. operating frozen food that exceeded the shelf life and abnormal sensory properties
   On January 21, 2021, Dong’an County Market Supervision and Administration Bureau of Yongzhou City conducted law enforcement inspections on the Dong’an branch of a supermarket limited company operating frozen foods that exceeded the shelf life and abnormal sensory properties. After verification, the party’s frozen pork suet with abnormal sensory properties weighed 15Kg, and 3 packs of”Haoming” brand fresh chicken exceeded the shelf life. The above two items totaled 942 yuan. They have not been sold yet, and there is no illegal income. The above actions of the parties violated Article 34 (6) and (10) of the Food Safety Law of the People’s Republic of China. On February 8, 2021, the Market Supervision and Administration Bureau of Dong’an County, Yongzhou City issued the following penalties in accordance with Article 124, Paragraph 1, Item (4) and Item (5) of the Food Safety Law of the People’s Republic of China:1. Order to be corrected; 2. Confiscate 15 kilograms of frozen pork suet oil with abnormal sensory properties and 3 packs of”Haoming” brand fresh chicken that has exceeded the shelf life; 2. A fine of RMB 10,000.
  5. Case of a meat business in Yangmou, Kaifu District, Changsha City that failed to be quarantined in accordance with regulations
   On February 1, 2021, the Market Supervision and Administration Bureau of Kaifu District, Changsha City carried out law enforcement inspections on the behavior of a trader Yang in Sifangping Commercial City, Changsha City, on operating raw pork without quarantine certificate and without quarantine seal. Upon verification, the parties involved had a total of 950.3 kg of pork that had not been inspected and quarantined, and the value of the goods was 5,1316.2 yuan. None of them was inspected and quarantined in accordance with the regulations, and the parties did not apply for a valid”business license”. Their behavior is suspected of constituting the”Criminal Law of the People’s Republic of China””The crime of producing and selling food that does not meet safety standards” as stipulated in Article 143. According to the”Criminal Law of the People’s Republic of China” and other relevant regulations, on February 1, 2021, the Kaifu District Market Supervision and Administration Bureau of Changsha City transferred the case to the Kaifu Branch of the Changsha City Public Security Bureau for investigation.
