  1. Definition of genetically modified food

   There is no direct definition of genetically modified food in my country’s current regulations and standards, combined with the popular science information in the “Genetically Modified” column of the Ministry of Agriculture and Rural Affairs and the relevant laws and regulations on “genetically modified” definition. Genetically modified food refers to food processed and produced using genetically modified organisms or organisms as raw materials.

  Second, regulatory authorities

   The supervision of genetically modified food in my country is mainly divided into two stages. The first stage is the management of genetically modified food raw materials (that is, genetically modified organisms); the second stage is the management of genetically modified foods.   The Ministry of Agriculture and Rural Affairs is the main department in the first stage of genetically modified food supervision. It is responsible for the supervision and management of the safety of agricultural genetically modified organisms nationwide, and adopts a safety evaluation system for genetically modified organisms. The safety assessment work is under the responsibility of the Agricultural Genetically Modified Organisms Safety Committee.    3. Legal and regulatory system

   The Regulations on the Safety Management of Agricultural Genetically Modified Organisms are the main basis for the management of genetically modified foods. The Regulations require that agricultural genetically modified organisms be researched, tested, and produced within the territory of the People’s Republic of China. Practitioners in, processing, operating, and import and export activities must comply with it.

   Based on the”Regulations on the Safety Management of Agricultural Genetically Modified Organisms”, it subsequently promulgated 5 supporting regulations for the research, testing, production, processing, operation, import and export of genetically modified organisms . That is, the”Administrative Measures for the Safety Evaluation of Agricultural GMOs”,”Administrative Measures on the Safety of Import of Agricultural GMOs”,”Administrative Measures on the Labeling of Agricultural GMOs”,”Approval Measures for Agricultural GMO Processing” and”Administrative Measures on Inspection and Quarantine of Entry and Exit GMO Products.” Corresponding to the three supporting regulations, there are also three management procedures, namely”Agricultural GMO Safety Evaluation Management Procedure”,”Agricultural GMO Import Safety Management Procedure” and”Agricultural GMO Label Examination and Approval Procedure”, which has further strengthened Safety management of agricultural genetically modified organisms.

   In addition, the”Food Safety Law” and”Seed Law” and other laws and regulations also stipulate the related content of genetic modification.

  IV. Supervision measures

  4.1 Security Evaluation System

   my country implements a safety evaluation system for genetically modified organisms at the source of genetically modified food. The”Administrative Measures for the Safety Evaluation of Agricultural Genetically Modified Organisms” stipulate that the research, testing, production, processing, operation, import and export of agricultural genetically modified organisms within the territory of the People’s Republic of China require safety evaluation.

  The safety assessment work is based on the three categories of plants, animals, and microorganisms. It is based on science and the principle of case review, and implements hierarchical and phased management. According to the degree of danger to humans, animals, plants, microorganisms and the ecological environment, agricultural genetically modified organisms are divided into the following four levels:safety level I:no danger yet; safety level II:low risk; safety level III:medium Degree of danger; safety level IV:highly dangerous. Those engaged in research on agricultural genetically modified organisms with safety levels III and IV within the territory of the People’s Republic of China, units engaged in the testing and import of agricultural genetically modified organisms of all safety levels, as well as units and individuals producing and processing shall be based on the categories and categories of agricultural genetically modified organisms. For the safety level, report to or apply for the agricultural genetically modified organisms safety management office. The application materials shall be prepared in accordance with the”Administrative Measures for the Safety Evaluation of Agricultural Genetically Modified Organisms”. Import declaration materials must be prepared in accordance with the requirements in the”Administrative Measures on the Import of Agricultural Genetically Modified Organisms” before import.

   Those who pass the safety evaluation will obtain the agricultural genetically modified organism safety certificate. my country has approved two types of safety certificates. The first is to approve the self-developed safety certificates for the production and application of insect-resistant cotton, virus-resistant papaya, insect-resistant rice, high phytase corn, petunia with altered flower color, disease-resistant sweet pepper, and disease-resistant tomato. At present, only genetically modified cotton and papaya are commercially grown; genetically modified rice and corn have not yet passed the variety certification and have not been approved for planting; the safety certificates for genetically modified tomatoes, sweet peppers and petunia have expired, and they have not actually been planted. The second is to approve import safety certificates for soybeans, corn, rapeseed, cotton, sugar beet and other crops developed by foreign companies. Imported agricultural genetically modified organisms are only approved as raw materials for processing and are not allowed to be grown in China.

  4.2 Production and Operation License

   The”Approval Measures for the Processing of Agricultural Genetically Modified Organisms” stipulate that those engaged in the processing of agricultural genetically modified organisms using active agricultural genetically modified organisms as raw materials within the territory of the People’s Republic of China Units and individuals shall obtain the agricultural genetically modified organisms processing license issued by the agricultural administrative department of the provincial people’s government where the processing is located. The specific application materials and required qualifications to be submitted are detailed in the”Approval Measures for Agricultural Genetically Modified Organisms Processing”.

  ”Agricultural Genetically Modified Organisms Safety Evaluation and Management Procedures” stipulates that the production and operation of genetically modified plant seeds, breeding livestock and poultry, and aquatic seedlings must be issued by the Ministry of Agriculture.   4.3 Import safety management

Both domestic and imported foods need to be strictly observed, and the Ministry of Agriculture and Rural Affairs and the General Administration of Market Supervision and Administration are jointly responsible for supervision. According to the”Administrative Measures for the Inspection and Quarantine of Import and Export Genetically Modified Products”, the General Administration of Customs has adopted various methods (including trade, processing with supplied materials, mailing, carrying, production, generation of reproduction, scientific research, exchange, exhibition, assistance, gift and other methods) The entry and exit of genetically modified products shall be subject to inspection and quarantine.

   For imported genetically modified products listed in the agricultural genetically modified organisms catalog under label management, if the declaration is genetically modified, the customs will implement compliance testing for genetically modified items, such as If the declaration is non-GMO, the customs will conduct random inspections of genetically modified items; for imported animals and plants and their products, microorganisms and their products and foods that are not in the agricultural genetically modified organisms catalog under label management, the customs will implement random inspections of genetically modified items according to the situation. Those who pass the genetic modification test shall be allowed to enter the country. If one of the following situations occurs, the customs will notify the owner or his agent to return or destroy the goods:(1) Declared as a genetically modified product, but the genetically modified ingredients are tested to be inconsistent with the”Agricultural Genetically Modified Organism Safety Certificate”; (2) Declared as a non-GMO product, but tested to contain genetically modified ingredients. Imported agricultural genetically modified organisms that are not marked in accordance with the regulations can enter the country after re-marking.

   5. Summary

   The supervision of genetically modified food in my country is basically concentrated at the front end of the entire industrial chain, that is, the supervision of agricultural genetically modified organisms. The safety evaluation of the research, testing, production, processing, operation and import of agricultural genetically modified organisms shall be carried out, and the corresponding production, operation, import and other activities shall be carried out only after obtaining the agricultural genetically modified organism safety certificate, production license and operating license.
