Six typical cases are now announced.
1. Case of Laoweiyuan Restaurant in Liulin County, Luliang City using food ingredients that do not meet food safety standards
On November 7, 2020, law enforcement officers from the Market Supervision Bureau of Liulin County, Luliang City inspected Laoweiyuan’s restaurant and found that the peanuts sold by it had exceeded the standard for aflatoxin, and the inspection result was judged to be unqualified . The behavior of the parties violated the provisions of Article 50, Paragraph 1, Article 3 of the Food Safety Law of the People’s Republic of China, and in accordance with the provisions of Article 125, Paragraph 1, Paragraph 4 of the Food Safety Law of the People’s Republic of China, An administrative penalty of 5,000 yuan was imposed on the parties.
2. Case of selling counterfeit registered trademark products at Xintong Tobacco and Alcohol Supermarket in Yuxian County, Yangquan City
On December 11, 2020, the Market Supervision Bureau of Yuxian County, Yangquan City, based on the clues of the case, inspected the Xintong Tobacco, Alcohol and Non-staple Food Store on Taoyuan Road, Yuxian County. During the inspection, it was found that the store sold 6 series of Fenjiu Jing The identified products are all counterfeit registered trademarks of Shanxi Xinghua Village Fenjiu Group Co., Ltd. The party’s act of selling goods that infringed on the exclusive right to use a registered trademark violated Article 57 (3) of the Trademark Law of the People’s Republic of China. In accordance with the provisions of Article 60, Paragraph 2 of the”Trademark Law of the People’s Republic of China”, the following administrative penalties were imposed on them:1. Confiscation of 41 boxes and 36 bottles of 6 series of Fenjiu illegally sold; 2. A fine of 10,000 yuan.
3. Case of melon seeds produced by Luwa Food Factory in Yuncheng Airport Development Zone that did not meet food safety standards
On August 28, 2020, law enforcement officers from the Salt Lake District Market Supervision Bureau of Yuncheng City, based on the clues of the case, inspected the Luwa Food Factory in the Airport Development Zone in accordance with the law and found that the scattered multi-flavored sunflower seeds produced by it were tested for saccharin sodium. Meet the requirements of national food safety standards and the use of food additives, and judged as unqualified products. The party’s behavior violated Article 34(4) of the Food Safety Law, and in accordance with the provisions of Article 124(3) of the Food Safety Law, the party’s illegal activities were confiscated. And a fine of 60,000 yuan for administrative punishment.
4. Case of unqualified food production and operation in a peel processing workshop in a village of Baode County, Xinzhou City
On December 9, 2020, the Xinzhou City Market Supervision Comprehensive Administrative Law Enforcement Team inspected a peeling workshop in a village in Baode County based on the clues of the case, and found that it produced batches of crystal peels on November 25, 2020. After the inspection does not meet the national food safety standards and the relevant requirements for the use of food additives, the inspection conclusion is unqualified. The behavior of the parties violated the provisions of Article 34 (2) and (4) of the”Food Safety Law of the People’s Republic of China”, in accordance with Article 41, Article 41 of the”Management Regulations of Shanxi Province on the Management of Small Food Workshops and Small Stores” (2) Provisions impose the following administrative penalties on the parties:1. Order to correct the illegal behavior and recall related products; 2. Confiscate the illegal income and impose a fine of 4,100 yuan.
5. The production and sale of rice noodles by Shanxi Laofanren Food Co., Ltd. in Linyi County, Yuncheng City does not meet the national standard limit case
On July 29, 2020, law enforcement officers of the Market Supervision Bureau of Linyi County, Yuncheng City, based on the clues of the case, conducted an on-site inspection of the company in accordance with the law and discovered the Laofanren Beijing flavored rice noodles produced by Shanxi Laofanren Food Co., Ltd. The peroxide value in the inspection items does not meet the requirements of relevant national standards. The behavior of the parties violated Article 34 (2) of the Food Safety Law of the People’s Republic of China. In accordance with Article 124 (1) of the Food Safety Law of the People’s Republic of China, the following administrative penalties were imposed:1. Confiscation of illegal income of 9,600 yuan; 2. A fine of 50,000 yuan.
VI. The case of the sale of toxic and harmful foods at the Dameijiyan Hotel in Yungang District, Datong City
On November 20, 2020, law enforcement officers of the Market Supervision Bureau of Yungang District, Datong City received reports from the masses and inspected the “Dameijiyan Hotel” located at the south gate of J District, Heng’an New District, Yungang District. No purchases were found on the spot. The law enforcement officers sent the relevant products for inspection immediately after importing the bills, the supplier’s qualifications and the inspection report of the”Cerdyceps Deer Whip King” and”Golden Maca” products. Upon inspection, the products contained the illegal”Sidenafil” substance. The Yungang District Market Supervision Bureau transferred the case to the Yungang District Public Security Bureau for investigation. The case is currently under investigation.
