Announcement of the Qinghai Provincial Market Supervision Administration on the Inspection and Disposal of 5 Batches of Unqualified Foods (No. 8 of [2021])

  In the 2020 food safety supervision random inspections recently organized by the State Administration for Market Regulation, there are 5 batches of unqualified foods involved in the food circulation and catering links in our province. The inspection and disposal of unqualified foods are now notified as follows:
  1. Basic situation of random inspection
   (1) On November 12, 2020, the sesame cake (production date:2020-10-18, specification:measurement sales) sold at the Yongsheng Vegetable Food Comprehensive Store in Delingha City will be subject to food safety supervision and random inspection, and nominal production Enterprise:Hebei Ma’s Kangda Food Co., Ltd., sample number:GC20000000002632346. After inspection by Nanjing Product Quality Supervision and Inspection Institute, the items of dehydroacetic acid and its sodium salt (calculated as dehydroacetic acid) did not meet the requirements of GB 2760-2014″National Food Safety Standard Food Additives Use Standard”, and the inspection conclusion was unqualified.
   (2) On November 12, 2020, conduct food safety supervision and random inspection on leeks sold at Guo Xili Vegetable Shop in Delin Farmers’ Market, Haidong City, sample number:GC20000000002733252. After inspection by Zhejiang Fangyuan Inspection Group Co., Ltd., the lead (in terms of Pb) project did not meet the requirements of GB 2762-2017″National Food Safety Standard Limits of Contaminants in Foods”, and the inspection conclusion was unqualified.
   (3) On November 9, 2020, the mantis shrimp (purchase date:2020-11-8) sold at the Kongda Seafood Store in Chengxi District, Xining City was subject to food safety supervision and sampling. The sample number:GC20000000002733326, Zhejiang Fangyuan Inspection Group Co., Ltd. inspected and found that the cadmium (calculated as Cd) item did not meet the requirements of GB 2762-2017″National Food Safety Standards Limits of Contaminants in Foods”, and the inspection conclusion was unqualified.
   (4) On November 13, 2020, the mantis shrimp (purchase date:2020-11-12) sold by the Hanqin Aquatic Seafood Wholesale Department in the West District of Xining City will conduct a food safety supervision and random inspection. The sample number is GC20000000002733238, After inspection by Zhejiang Fangyuan Inspection Group Co., Ltd., the cadmium (calculated as Cd) item did not meet the requirements of GB 2762-2017″National Food Safety Standards for Contaminants in Foods”, and the inspection conclusion was unqualified.
   (Five) On November 12, 2020, the celery sold at Xiaoguigua Fruit and Vegetable Shop in Pingan District, Haidong City (purchase date:2020-11-12) will be inspected for food safety supervision. Sampling sheet number:GC20000000002733249 , After inspection by Zhejiang Fangyuan Testing Group Co., Ltd., the chlorpyrifos project did not meet the requirements of GB 2763-2019″National Food Safety Standard Maximum Residue Limits of Pesticides in Foods”, and the inspection conclusion was unqualified.
  2. Inspection and disposal of unqualified food
   (1) The Delingha Market Supervision Bureau of Haixi Prefecture initiated an investigation into the Yongsheng Vegetable and Food Comprehensive Store in Delingha. The store sells food that does not meet the national food safety standards, violating Article 34, paragraph 4 of the Food Safety Law of the People’s Republic of China. In the process of purchasing food, the parties strictly fulfilled the obligations of food purchase inspection, request for evidence and tickets, which can explain the source of the purchase, and the parties did not know that the batch of sesame cakes was substandard food. According to Article 136 of the”Food Safety Law of the People’s Republic of China”, food operators have fulfilled the obligations of purchase inspections stipulated in this law and have sufficient evidence to prove that they do not know that the food they purchase does not meet the food safety standards, and Those who can truthfully state the source of their purchases can be exempted from punishment. The Market Supervision Bureau of Delingha City in Haixi Prefecture decided to exempt the parties from punishment and review the rectification of the enterprise.
   (2) On-site investigation by the Market Supervision Bureau of Pingan District, Haidong City on the Guo Xili Vegetable Shop in Delin Farmers Market, Haidong City. The store’s act of selling food that did not meet the standards violated Article 34, Paragraph 2 of the Food Safety Law of the People’s Republic of China. After investigation, the parties involved strictly fulfilled the obligations of food purchase inspection, proof and ticketing during the process of purchasing food, and can explain the source of the purchase. According to Article 136 of the”Food Safety Law of the People’s Republic of China”, food operators have fulfilled the obligations of purchase inspections stipulated in this law and have sufficient evidence to prove that they do not know that the food they purchase does not meet the food safety standards, and Those who can truthfully state the source of their purchases can be exempted from punishment. The Market Supervision Bureau of Pingan District, Haidong City issued an on-the-spot penalty decision, ordering the parties to make rectification immediately, and issued a warning administrative penalty.
   (3) Law enforcement officers of the Chengxi District Market Supervision Bureau of Xining City initiated an investigation into the Kunda Seafood Store in Chengxi District, Xining City. The seafood store’s operation of food that did not meet the national food safety standards violated Article 34, paragraph 2 of the Food Safety Law of the People’s Republic of China. After investigation, during the process of purchasing food, the parties asked for the batch of purchase receipts, supplier qualifications and inspection certificates, and fulfilled the obligations of food purchase inspection, proof and receipt. According to the Food Safety Law of the People’s Republic of China, the first Article 136 stipulates that food business operators who have fulfilled the obligations of inspection of purchases stipulated in this law and have sufficient evidence to prove that they do not know that the food they purchase do not meet food safety standards and can truthfully state the source of their purchases may be exempted Punishment. The Market Supervision Bureau of Chengxi District of Xining City decided to exempt the parties from punishment.
   (4) The Market Supervision Bureau of Chengxi District, Xining City initiated an investigation of the Hanqin Aquatic Seafood Wholesale Department in Chengxi District, Xining City. The food that the operator did not meet the national food safety standards violated Article 34, paragraph 2 of the Food Safety Law of the People’s Republic of China. After investigation, during the process of purchasing food, the parties asked for the batch of purchase receipts, supplier qualifications and inspection certificates, and fulfilled the obligations of food purchase inspection, proof and receipt.
