On January 5, 2020, the European Union notified the WTO of the draft directive (G/SPS/N/EU/407/Add.1), which revised the measures on the tomato brown wrinkle fruit virus. This supplementary notification revises the proposal notified in the G/SPS/N/EU/407 (August 19, 2020) notification and updates the requirements for internal transportation and import.
For practical reasons, according to the official inspection of the designated pests at the appropriate time, the seeds harvested before August 15, 2020 cannot meet the requirements for producing their mother plants on the production site where no designated pests are found . Therefore, such seeds shall be exempted from the requirements of Article 7(1)(a) and Article 9(1)(a)(i) of the Implementing Regulations (EU) 2020/1191.
These designated seeds originating from third countries should be tested using the sampling and testing methods described in the Annex of Implementation Regulation (EU) 2020/1191. Considering that certain designated seeds may have been tested several months before the actual export certification, mandatory molecular testing will be required from April 1, 2021, and third countries will be given time to adapt to this requirement.
